Terms and conditions

1. Contracting party and applicability

Your contracting party is CODERS.WIN LLC, 2880 W Oakland Park Blvd, Suite 225C, Oakland Park, FL 33311, USA, represented by Marius Korbmacher. References to “I” mean Marius acting on behalf of the company.

These services are exclusively for businesses acting for business purposes. By booking, you confirm that you are authorised to act for the named business. Individually agreed terms take precedence over these terms.

2. Booking

Submitting the form using “Place binding order” places a binding order. The contract is formed when you receive the booking confirmation by email. It includes the invoice and next steps.

The service description, price and terms displayed when you book apply. A request in the notes field does not automatically change the offered scope. Any changes need to be expressly agreed.

3. Services and scope

Social proof audit: an analysis of your store with prioritised recommendations. Audit + blueprint: also includes technical specifications and an implementation plan for your team or agency. Neither service includes theme implementation.

4-Week Done-for-You Social Trust Setup: audit, blueprint, data integration, implementation in your store design, before-and-after measurements, one revision round, quality assurance and handover. The booking covers the Shopify store you provide. We record the specific scope and design direction in the plan at the start of the project.

Additional stores, new requirements or ongoing support after handover are agreed separately. I only start additional paid work after you approve its scope and price.

4. Price and payment

The price displayed when you book applies, in euros and including selected discounts. Prices are net of any legally applicable taxes. Tax treatment is stated on the invoice and depends on the actual circumstances and applicable tax law.

Audit and blueprint services are paid in full before work starts. For the Done-for-You Setup, 50% is invoiced after booking and 50% after acceptance of the agreed implementation in the draft theme. Each invoice is payable within 14 calendar days of its date. Work starts after the advance payment is received.

The FiveOh app subscription and other separately purchased app subscriptions are excluded from the project price. Their respective prices and terms apply. No app subscription is required for the audit or blueprint.

5. Done-for-You Setup discounts

The discounts displayed in the booking form and selected by you at the time of booking apply. Later changes to discount amounts do not affect existing bookings. Both discounts can be combined. The reduced total is split equally between the deposit and final payment.

Quick booking: You receive the discount if you book within five working days of receiving the implementation plan. Working days mean Monday to Friday, excluding public holidays at your business location, counted from the following working day. The discount is deducted immediately and checked internally afterwards. If the deadline was missed, I will let you know and invoice the difference.

Case study: You receive the discount if you permit the use of your brand and the delivered work as a reference and provide honest feedback after the project. A positive review is not required. I will not publish confidential business information or personal customer data. Quotes and non-public metrics will be agreed with you before publication.

6. Your input and access

You provide the required information, data, design direction and access, and name a contact with decision-making authority. You ensure that the supplied content and data may be used for the project. Feedback and approvals are consolidated through that contact.

Shopify access is provided through a collaborator request that you approve. Installing an app does not replace that approval. For other systems, use separate user accounts or a secure sharing method. Do not send passwords by ordinary email. During implementation, we coordinate any changes your team or other providers make to affected areas.

7. Schedule and delivery guarantee

The four-week delivery period for the Done-for-You Setup begins once the deposit and all required access and information are in place. This includes collaborator access, the theme, access to your existing review app where needed, a design direction and a contact with decision-making authority. You receive the start date and a schedule with milestones and approvals by email. Delivery dates for the audit and blueprint are confirmed separately.

The delivery period pauses while required access, information, feedback or approvals from you are missing. I will explain the reason and its effect on the schedule. For agreed additions to the scope, we also agree the extra time required.

For every full week of delay that I am responsible for, you receive €500 credit towards the Done-for-You Setup final payment, capped at that payment's amount. I will still complete the agreed work. Your statutory rights remain unaffected.

8. Revision, acceptance and publishing

Implementation takes place in a draft theme. Changes to the live theme and publication require your express approval. Any necessary changes to shared store data or app settings are agreed with you beforehand.

The implementation follows the agreed design reference. An exact match down to individual pixels across all devices and browsers is not required. Minor technical differences are permitted as long as the agreed overall appearance and functionality are preserved. Any material differences will be agreed with you in advance.

One consolidated revision round within the agreed scope is included. Correcting defects in the agreed deliverables does not count as a revision round and remains unaffected by that limit.

Once the implementation is complete, you review it in the draft theme and confirm acceptance or report specific defects. The final payment is invoiced after acceptance, even if you choose not to publish. Approval to publish is a separate decision.

9. Deliverables and confidentiality

After full payment, your business may use the project-specific reports, plans and theme customisations indefinitely and have your team or agency modify them. This does not transfer ownership of FiveOh, existing tools or third-party software. Their respective licences apply.

I treat non-public business information and access credentials as confidential and use them only for our work together. This duty continues after the project ends. People and service providers I involve in delivering the work receive only the information needed for their role and are bound by equivalent confidentiality obligations. Reference use requires your permission. Where access to personal data requires a data processing agreement, we will enter into it before that access takes place.

10. Results and responsibility

The deliverable is the agreed analysis or technical implementation. Increases in revenue, conversion or traffic, specific Lighthouse scores, rankings or visibility in AI answers are not guaranteed. Measurements document the state at the time under the stated test conditions.

Defect remedies and liability are governed by applicable law. The delivery guarantee does not replace or limit those rights.

11. Rescheduling or ending the project

If you want to reschedule or end the project, contact me by email. We agree any revised schedule together. Cancellation, termination and payment for completed or outstanding work are governed by applicable law. Payments already made are taken into account in the final settlement.
